Hurricane Enduro Rentals - Liability Waiver and Release

1. Assumption of Risk

I acknowledge that off-road motorcycle riding involves inherent risks including, but not limited to: falls, collisions, equipment failure, rough terrain, weather conditions, and encounters with other riders or vehicles. I voluntarily assume all such risks, known and unknown, and take full responsibility for my participation.

2. Release of Liability

I release Hurricane Enduro Rentals, its owners, employees, agents, and representatives from any and all liability for injury, damage, death, or loss arising from my participation in motorcycle rental activities, to the fullest extent permitted by law. This includes, but is not limited to, claims based on negligence, breach of contract, or any other legal theory.

3. Safety Gear Agreement

I agree to wear all required safety gear (helmet, goggles, boots, and gloves) at all times while operating the motorcycle. I understand that failure to wear proper safety gear voids any damage protection and may result in additional liability. I acknowledge that Hurricane Enduro Rentals provides safety gear and I will inspect it before use.

4. Indemnification

I agree to indemnify and hold harmless Hurricane Enduro Rentals from any claims, damages, losses, or expenses (including attorney fees) arising from my rental activities, including claims made by third parties. This indemnification extends to any damage I cause to the motorcycle, property, or persons during my rental period.

5. Medical Fitness

I certify that I am physically and mentally fit to operate a motorcycle and have no conditions that would impair my ability to ride safely. I understand that operating a motorcycle under the influence of alcohol or drugs is strictly prohibited and will result in immediate termination of the rental without refund.

6. Equipment Responsibility

I agree to operate the motorcycle in a safe and responsible manner, following all applicable laws and regulations. I will immediately report any mechanical issues or damage to Hurricane Enduro Rentals. I understand that I am financially responsible for any damage to the motorcycle during my rental period, subject to the terms of any damage protection I may have purchased.

7. Photo/Video Release (Optional)

By opting in, I grant Hurricane Enduro Rentals permission to use any photographs or videos taken during my rental for marketing, promotional, or educational purposes without compensation.

8. Governing Law

This waiver shall be governed by and construed in accordance with the laws of the State of Utah. Any disputes arising from this agreement shall be resolved in the courts of Washington County, Utah.
